Client Release, Rights Warranty and Media Consent

Every client signs this Release electronically with each order or free sample request. It is part of our Terms of Service. This page is for reference; sign it on the order page.

In consideration of the services provided by All Around Digital Media, 17810 W. Dixie Hwy, Suite C, North Miami Beach, FL 33160, I agree:

  1. Rights to the materials. I own, or have every license and permission needed to provide, all photos, videos, logos, text and other materials I submit or point to for this order, including any permission required from the photographer. I have authority to market the property, product, service, brand or business shown, including any consent needed from its owner, seller, landlord, community management, manufacturer or trademark owner, and anyone who can be identified in the materials has consented to their use.
  2. Use of AI and editing tools. I authorize All Around Digital Media to edit my materials and to process them with AI image and video tools and other software to create the ordered media. I understand AI can produce imperfections, and that some services intentionally add elements that are not in my photos, such as virtual furniture, AI-generated people, movement, lighting, sky, created scenes or new settings for my products.
  3. Review before publishing. I will review every file before I publish it and request corrections for anything that could misrepresent the property, product or service, including product details, label text and logos. I am solely responsible for anything I publish.
  4. Delivery and download. I understand my final files will be delivered by a Dropbox link that stays active for 10 days from delivery. I am responsible for downloading and saving them within that time. After 10 days the files may no longer be available, and retrieving and resending them, if still possible, costs $29 per order. Revisions must be requested within 5 days after the preview is sent.
  5. Advertising compliance. I am solely responsible for complying with MLS rules, real estate license and advertising laws, fair housing laws, laws requiring disclosure of altered or virtually staged images, my brokerage's policies, FTC advertising and endorsement rules, rules for regulated products and services such as cosmetics, foods, supplements and financial services, and platform rules wherever I use the media. I am responsible for the accuracy and substantiation of any claims about my products or services, and I will not present AI-generated people as real customers. All Around Digital Media does not give legal or compliance advice.
  6. Advertising and portfolio consent. I grant All Around Digital Media a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, display, publish and distribute the photos and materials I provide, and all images and videos created from them, including before-and-after comparisons, in its portfolio, website, social media, advertising and other promotional materials, without payment or approval, as described in Section 14 of the Terms of Service.
  7. Release. To the fullest extent permitted by law, I release, waive and discharge All Around Digital Media and its owners, employees and contractors from all claims, demands and liability arising from the use of AI tools, edits, the content of the media, my publication or use of the media, or any claim that the media misrepresents the property, product or service, except to the extent caused by their gross negligence or willful misconduct.
  8. Indemnity. I will defend, indemnify and hold harmless All Around Digital Media from any claim, loss, fine or expense, including reasonable attorneys' fees, arising from my materials, my breach of this Release or the Terms, or my use of the media, including claims by photographers, property owners, trademark owners, buyers, customers, tenants, guests, MLSs, regulators or platforms.
  9. Agreement and signature. This Release is part of, and incorporates, the Terms of Service and Privacy Policy, including the limitation of liability and the Florida governing law and Miami-Dade County venue terms. Typing my name and submitting the order form is my electronic signature. If I sign for a business, I am authorized to bind it.
